Definitions
"Print It Fast" refers to Purplex Design & Print Pty Ltd of 2/60 Genista Street, San Remo VIC 3925 ABN: 20 051 377 377
"Customer" means any person, company, partnership, organisation or body at whose application, Print It Fast agrees to provide the Services under the terms of the agreement.
"Agreement" means the contract between Print It Fast and the Customer to which these conditions will apply.
"Services" means the project agreed upon with the Customer, either by formal brief, or informal communications including but not limited to email, telephone and in person. Where necessary a brief form will be supplied outlining the agreed upon project details.
"Order" means confirmation by the Customer of its acceptance of the quotation and/or brief given by Print It Fast.

1 GENERAL
1.1 These terms and conditions shall be incorporated into any contract by Print It Fast for the supply
of goods and services, including but not limited to component parts, assembled products,
labels, printed matter and design services including but not limited to drawings, designs,
artwork and electronic files for screen based and printed media. To the extent that these
terms and conditions are inconsistent with any terms and conditions assumed by the
customer, then the inconsistent terms and conditions of the customer shall be void and have
no effect. The term "the goods and services" where appearing in these terms and conditions
shall include those goods and services for which a price is quoted by Print It Fast to the customer
and shall include any plans, designs, specifications, text, images or instructions supplied by
the customer.
1.2 For all legal purposes, this agreement shall be deemed to have been made in Victoria,
Australia.
1.3 The waiver by Print It Fast of any term, condition or obligation of this agreement shall be
deemed to be a continuing waiver of the term, condition or obligation. It will have no effect
unless issued in writing to the Customer and signed by an authorised Director of Print It Fast.
1.4 This agreement may be terminated by Print It Fast at any time by posting a written notice from
Print It Fast to the customer and on the posting of such notice this agreement shall be at an end.
1.5 This agreement shall not be assigned to any other party by the Customer without the prior
written consent of Print It Fast.
1.6 Print It Fast shall be entitled to claim authorship for products, screen-based and printed media
made wholly or substantially to our design, and use such designs as samples on various
promotional materials. If you do not consent to your Project being displayed in such a
manner, this will need to be advised, in writing, prior to the commencement of the Project.
The Customer may not without Print It Fast approval use our name in connection with products,
screen-based and printed media that have been altered from our design.

2 PRICE AND PAYMENT
2.1 The prices quoted are current at the date of quotation and are firm for 30 days from the date
of the proposal. Orders placed after the 30 day term has expired may be subject to alternate
pricing, this will be advised prior to commencement of the Project.
2.2 Ownership of goods (including designs) shall not be passed from Print It Fast to the customer
until Print It Fast has received payment for the goods in full from the Customer, regardless of if
the goods have been delivered to the customer. Upon delivery to the customer, its servants,
agents or sub-contractors the goods are held at the Customer's risk until payment has been
made.
2.3 Any default in payment by the customer shall entitle Print It Fast to cease any further work being
carried out by Print It Fast on behalf of the customer and the customer shall be liable to pay to
Print It Fast the value of any work carried out and all materials provided by Print It Fast up to and
including the date of cessation of the work. Orders entered upon Print It Fast books cannot be
cancelled without Print It Fast prior written consent and upon cancellation the customer shall
indemnify Print It Fast against loss.
2.4 Print It Fast shall be entitled in the event of the Customer's bankruptcy or insolvency or where
the Customer enters into a scheme or an arrangement with creditors or where the Customer
is a company and enters into receivership or liquidation, either voluntarily or compulsory, to
demand the full purchase price of the goods and services payable in cash. Print It Fast shall be
entitled in default of payment to rescind this agreement and sue the customer for the value
of the work completed and the materials provided at the date of demand plus the cost of
recovery.
2.5 For all projects payment is required prior to commencement of design and/or printing, unless
otherwise arranged in writing with Print It Fast.
2.6 Unless otherwise arranged, in writing, with agreement by Print It Fast, any accounts outstanding
for supply of goods and/or services for a period in excess of 14 days, will be subjected to a
charge of 10% interest per month calculated daily from the date of invoice. Print It Fast reserves
the right to add the cost of debt recovery to an outstanding debt. The cost of debt recovery
is subject to the same payment terms as any other outstanding amount.
2.7 All goods quoted include bulk packing at reasonable commercial standards. Any special
markings, individual packing materials, delivery instructions will be at the customers cost.
2.8 Variations requested by the customer outside of the agreed upon brief shall be charged at
the price determined by Print It Fast in addition to any other money due.
2.9 The copyright of all designs and the rights to Design Registration will be automatically
assigned to the Customer upon completion of work and payment of all fees.

3 DELIVERY
3.1 Print It Fast offers insurance and registration options on all deliveries, if the Customer chooses to
have their goods delivered with an “Authority to Leave” in the case of courier delivery, or by
standard post, in the case of Australia Post mail, they waive any right to refunds or reprints at
Print It Fast’s cost.
3.2 Print It Fast assumes no responsibility or liability for any loss or damage occasioned by reason of
delay to supply or inability to deliver caused by Acts of God, fires, tempest, strikes, lock-outs,
accidents, embargoes, delays of carriers, delay in supply of materials, insurrection, riots, acts
of civil or military authority, variations to awards, or from any other cause which is
unavoidable or beyond the reasonable control of Print It Fast. If delays do occur, the delivery
date shall be correspondingly extended.

4 LIABILITY
4.1 Print It Fast assumes no liability for breaches of copyright that occur in using artwork supplied by
the Customer. Print It Fast assumes that the Customer has the necessary permissions to utilise
any items, including but not limited to, logos, photographs, drawings, wording and design
elements, provided by the Customer to Print It Fast in the manner in which they have been
requested to be used. This includes commercial licenses for goods for resale, and
photography releases for printing of photographs taken by professional photographers.
4.2 In addition Print It Fast has the right to refuse to take on a Project if it is deemed by Print It Fast
to be clearly, or possibly, in breach of copyright laws. When this is the case, a written release
form may be required to be signed by the Customer asserting their right to use the property
in question prior to commencement of the Project.
4.3 Print It Fast will not be liable for damages or other penalties caused by the inadequate
specifications for goods and services given by the Customer to Print It Fast. It is the Customer's
responsibility to describe the goods and services so that they are fit for their use. Print It Fast
accepts responsibility for fitness for purpose only against the original written advice from the
Customer.
4.4 All times suggested for design work for each stage of the project are estimates only and are
not meant to, nor shall they be regarded, as a condition of the agreement. We will not be
liable for any loss or damage resulting from such estimated time period not being met.
Print It Fast will endeavour to meet all dates, but will not assume any liability for deadlines
missed due to lack of communication by the Customer, or other circumstances beyond our
control.
4.5 Should the project be postponed or cancelled by the Customer, then the Customer shall be
liable for any fees, costs and expenses up to the time Print It Fast is notified in writing of such
cancellation.
4.6 Print It Fast accepts no liability for delivery estimates given by couriers, postal services or any
other Agents acting to deliver goods from Print It Fast to the Customer not being met.
Customers are welcome to organise their own methods of delivery and this needs to be
advised in writing to Print It Fast, prior to commencement of the Project.
4.7 All printed items in the Print It Fast catalogue are printed using a CMYK process, either on a wide
format digital machine, a digital press, or a traditional press. CMYK processes do not allow
for colour matching to previous runs and will always vary between jobs. We accept no liability
for colour variations in printed products. In addition your screen is not an accurate
representation of output from a printer and all proofs should be accepted as indicative
guides only. Should you require accurate colour matching, please contact us for a quote on
PMS spot colour printing.

5 WARRANTY
5.1 Print It Fast will remedy without charge to the customer any defects or failures which occur in
the goods within 7 days of the date of delivery of the goods (unless alternate warranty is
supplied at time of purchase) which in the opinion of Print It Fast is solely attributable to faulty
or defective workmanship, materials, or parts provided that the customer shall repackage the
goods for collection by an authorised Agent (arranged by Print It Fast) to return the goods to
Print It Fast premises within 10 days of the fault or defect occurring. The customer is only entitled
to replacement of the defective item can claim no further costs, loss or damage against
Print It Fast.
5.2 The extent of the liability of Print It Fast for the loss or damage of the goods or for loss or
damage arising or resulting from the use of the goods is limited to the extent provided in this
proposal and that provided in any Statute.

6 INDEMNITY AND DISCLOSURE
6.1 The customer shall indemnify Print It Fast against any damage or loss suffered by Print It Fast
arising from the infringement of patent, copyright, design, trademark or original work which
arises from Print It Fast complying with the customer's design, plans, specifications, text, images
or instructions.
6.2 Where goods are made to the customer's drawings and/or specifications, no responsibility
can be accepted for errors or inadequate details provided by the customer resulting in goods
not meeting specifications.

7 RETURN AND CREDIT
7.1 Print It Fast will not accept any products for return by courier or post without prior agreement by
Print It Fast in writing that the products should be returned for inspection. Where possible
photographs of the defects must be supplied prior to an authorisation to return being issued.
7.2 The acceptance by Print It Fast of the goods returned by the customer shall not ipsofacto entitle
the customer to any credit for those goods unless in the opinion of Print It Fast the goods are
faulty or defective in workmanship or materials to such an extent that they cannot be
repaired or replaced. Goods will not be accepted for credit unless the goods are
accompanied by a form of advice showing relevant Print It Fast invoice number, total quantity
supplied, quantity rejected and reasons for rejection within 7 days of delivery date. All
shortages are to be notified within 24 hours of delivery.

8 DISBURSEMENTS
8.1 For design services, materials and services costs will be the responsibility of the Customer.
We reserve the right, at our discretion, to charge a handling fee at the rate of 20% for these
costs which may include travel, accommodation and all out-of-pocket expenses incurred by
us during the project.

9 TERMS OF PAYMENT
9.1 All design work requires an up front, non refundable booking fee to the value of 50% of the
quoted amount for the project. This amount will be deducted from the final invoice. When
ordering through the website, full payment will be required up front, but should design work
be cancelled, 50% will be refunded. Payment of final invoice is due prior to hand over of
completed files and must be paid within 7 days of the project being completed.
9.2 All print work requires full payment up front prior to printing occurring. Printing will not
commence until payment has been made in full, and remittance advice provided to
iwanttoprintitfast@gmail.com.
